About the Firm
Glenn A. Garber, P.C. provides representation at all phases of criminal cases, including trials, appeals, and post-conviction proceedings. Located in downtown Manhattan, the firm handles a wide range of felony cases in a variety of courts including state and Federal courts in New York and New Jersey. Cases consist of homicides, white collar crime, fraud, conspiracy, robbery, gun possession, drug sale, and drug possession. A significant number of our cases are court-appointed.
In addition to a busy criminal trial and appellate practice, we have a growing number of exoneration and wrongful conviction cases. Our Exoneration Initiative is a pro bono component of the firm, modeled on the Innocence Project and similar organizations with a particular focus on non-DNA cases. Non-DNA cases do not involve biological evidence that could potentially exonerate wrongfully convicted individuals. These cases pose tremendous challenges and require extensive investigation and top-notch legal representation.
Job Description
Students will work on the firm's Exoneration Initiative. This work will entail screening potential cases for innocence, investigating the cases, meeting with clients, and assisting in the preparation of post-conviction motions, habeas corpus petitions, and clemency applications. Journalism students will primarily focus on the investigative side and law students on the legal side.
Students will also conduct legal research of the rapidly evolving law that is shaping both exoneration (via state equivalent of federal habeas corpus actions) and post-exoneration civil litigation (wrongful conviction claims against the state seeking monetary compensation). Particular areas of interest include the development of the judicially-created "actual innocence" doctrine, and failings in the criminal justice system (i.e., why and how wrongful convictions occur).
This is an unpaid internship.
Qualifications
Interest in criminal justice and strong research skills required. Second and third year law school students and graduate investigative journalism students preferred. Fluency in Spanish is a plus, but not required.
